Please read these terms carefully before using the CareConnect platform. By accessing our services, you agree to be bound by these terms.

Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and CareConnect Pvt. Ltd. ("Company," "we," "us," or "our") concerning your access to and use of the CareConnect teleradiology platform and related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our Services.

Important: These Terms include provisions that limit our liability and require individual arbitration for any disputes.

Eligibility and Account Registration

Eligibility Requirements

To use our Services, you must:

Be at least 18 years of age
Be a licensed healthcare professional or authorized representative of a healthcare organization
Have the legal capacity to enter into binding contracts
Not be prohibited from using the Services under applicable laws

Account Responsibilities

When you create an account, you agree to:

Provide accurate, current, and complete information

Maintain and promptly update your account information

Maintain the security and confidentiality of your credentials

Notify us immediately of any unauthorized access

Accept responsibility for all activities under your account

Permitted Use and License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use the Services for your internal business purposes
Upload and process medical imaging data for diagnostic purposes
Communicate with other authorized users on the platform
Access reports, analytics, and other features provided through the Services

All rights not expressly granted to you are reserved by CareConnect and its licensors.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

System Interference

Interfere with, disrupt, or create an undue burden on the Services or networks

Unauthorized Access

Attempt to gain unauthorized access to any part of the Services

Data Misuse

Use patient data for purposes other than providing healthcare services

Reverse Engineering

Decompile, reverse engineer, or attempt to extract source code

Automated Access

Use bots, scrapers, or automated tools without written permission

Resale or Transfer

Resell, sublicense, or transfer your access rights to third parties

Intellectual Property Rights

Our Property

The Services and all content, features, and functionality are owned by CareConnect and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without prior written consent.

Your Content

You retain all ownership rights to the medical images, patient data, and other content you upload to the Services. By uploading content, you grant us a limited license to:

Store, process, and transmit your content to provide the Services
Create de-identified aggregate data for improving our AI algorithms
Backup and restore your content for disaster recovery purposes

Payment and Billing

Access to certain features of the Services requires payment of fees. By subscribing to a paid plan:

Subscription Fees

You agree to pay all fees according to your selected subscription plan. Fees are non-refundable except as required by law.

Automatic Renewal

Subscriptions automatically renew unless cancelled at least 30 days before the renewal date.

Price Changes

We reserve the right to change pricing with 30 days' advance notice. Continued use after the price change constitutes acceptance.

Taxes

Fees are exclusive of taxes. You are responsible for all applicable taxes, duties, and assessments.

Service Modifications and Availability

We reserve the right to:

Modify, suspend, or discontinue any part of the Services at any time
Perform scheduled and emergency maintenance
Update features, functionality, or user interface
Implement security patches and improvements

We will provide reasonable notice of significant changes when possible, but we are not liable for any modification, suspension, or discontinuation of the Services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARECONNECT SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Service interruptions or data loss
Errors or inaccuracies in content or AI-generated recommendations

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Medical Disclaimer

IMPORTANT: The Services provide tools to assist healthcare professionals but do not replace professional medical judgment. All diagnostic decisions must be made by qualified, licensed healthcare professionals. We do not practice medicine and are not responsible for clinical decisions made using our platform.

AI-generated insights and recommendations are for reference only and should be independently verified by qualified radiologists before clinical use.

Termination

Either party may terminate these Terms:

By You: Cancel your subscription at any time through your account settings

By Us: Immediately if you breach these Terms or for any reason with 30 days' notice

Upon termination, your access will cease, and we may delete your data in accordance with our data retention policies. Provisions that by their nature should survive termination will remain in effect.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in San Francisco, California, except for claims that may be brought in small claims court.

Changes to These Terms

We may revise these Terms at any time. Material changes will be notified via email or prominent notice on our platform at least 30 days before taking effect. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
